Instances of abuse, neglect and financial exploitation, including undue influence, of older adults and people who have a disability have increased dramatically. Fortunately, Illinois has a statute which gives specific legal remedies to adult protective services provider agencies to combat the neglect, abuse, and financial exploitation. The remedies available to these agencies include Access Orders, Orders Freezing Assets and Emergency Consent Orders. When the provider agencies are unable to pursue legal intervention in these situations, a number of legal remedies are available to individuals as well including Guardianship and Orders under the Power of Attorney Act.
